Terms and Conditions
1. Acceptance of Terms

1.1. By using the website, booking services, or engaging in any form of communication with the Artist, you acknowledge and agree to these Terms and Conditions, even in the absence of a formal signature.
1.2. The Artist reserves the right to amend these Terms and Conditions at any time, with changes posted on the website. Continued use of the website or services constitutes acceptance of the updated Terms.
2. Enquiries and Consultations

2.1. The Client’s event must be officially confirmed before making an enquiry for a Live Painting.
2.2. When you make an enquiry through the Artist’s website or email, you consent to being contacted for further details and discussions about the services offered.
2.3. A provisional hold is placed on the event date upon initial enquiry; however, the booking is only confirmed once the Client Agreement is signed and the deposit is paid. The Client has 72 hours from receipt of the Client Agreement to sign and return it, after which a 14-day cooling-off period applies before the deposit is due. If the deposit is not paid within this timeframe, the date may be offered to other clients.
2.4. Phone/video consultations, included in service packages, are provided at no extra charge to clarify the event’s process, your vision for the painting and a timeframe of when the project is planned to be completed for you to view the final artwork.
3. Payment and Booking Policies

3.1. Pricing may vary, but a non-refundable 50% deposit is required to secure current rates and confirm your Live Wedding Painting booking. Bookings are not secured until the deposit is received.
3.2. The remaining 50% balance for a Live Event Painting is due 30 days before the event.
3.3. If the final payment for Live Event Bookings is not made on time, the booking may be cancelled.
3.4. Live Event bookings made with less than 30 days’ notice require full payment at the time of booking.
3.5. The Client is responsible for travel and accommodation costs (if necessary) beyond 30 miles.
3.6. Pricing may vary, but a non-refundable 50% deposit is required to secure current rates and confirm your Painting Commission booking. Bookings are not secured until the deposit is received.
3.7. The remaining 50% balance for a Painting Commission is due once the painting is completed.
3.8. If the final payment for a Painting Commission is not received within 7 days of completion, the deposit will not be refunded, and the artwork will remain with the Artist; non-personalised artwork (e.g. animal) may be sold publicly.
3.9. If a Painting Commission does not meet the Client’s agreed expectations and minor adjustments cannot rectify the issue, the final payment will be waived; but the artwork will remain with the Artist and non-personalised artwork (e.g. animal) may be sold publicly.

4. Live Event Painting
​
4.1. The Artist will arrive at the venue before the Event, at a time agreed with the couple, to set up. The Artist will paint live during the event, creating a full image on-site, with details and final touches completed after the event in the studio.
4.2. The Client is responsible for providing a suitable workspace, including shelter and electrical access.
4.3. The Artist may take photographs and videos of the painting process and guest interactions for promotional purposes. If the client prefers that no photographs or videos are to be used for promotional purposes of the day, they must inform the Artist in writing before the Event.
4.4. The Artist may engage with guests, but the primary focus will be on creating the painting.

5. Progress Updates and Changes
​
5.1. Clients will receive updates on the progress of their paintings with estimated completion times.
5.2. Estimated painting turnaround period is up to 12 weeks, which may vary due to several factors (e.g. painting touch-ups, Client discussions and approvals, varnishing and drying periods, other existing workload and commitments).
5.3. The Artist may share progress photos on social media unless the client requests otherwise. For gifts, no images will be shared publicly until the recipient has received the artwork.
5.4. Any modifications to the agreed scene or additional requests should be communicated before the Live Event; significant changes after the event may incur additional charges.

6. References and Materials for Commissions
​
6.1. Live wedding paintings are based on photographs taken by the Artist, while commissioned works use photos provided by the Client.
6.2. Clients must obtain permission to use any reference photos that they do not own, especially photos taken by professional photographers, and provide proof of this permission to the Artist.
6.3. The Artist reserves the right to decline a commission if the provided photos do not meet the required quality standards.
6.4. All paintings are created using high-quality acrylic paints on stretched canvas, and are varnished to protect against dust and UV damage.

7. Shipping and Handling
​
7.1. Finished artworks can be shipped with tracking and insurance within the UK, or collected in person at the Client's own expense. Items are securely packaged for protection. Additional charges apply for international shipping and the different options will be discussed with you.
7.2. The Artist is not responsible for delays or damages caused during transit.

8. Cancellation and Returns
​
8.1. If the Client cancels a booking, the deposit is non-refundable.
8.2. For cancellations made less than 30 days before a Live Event, the deposit and final payment will not be refunded.
8.3. In the unlikely event that the Artist must cancel, the full amount paid by the Client will be refunded.
8.4. Custom paintings are not eligible for returns, but prints may be returned if damaged, provided notification is made within 48 hours of receipt and return costs are covered by the Client.

9. Liability
​
9.1. The Artist is not liable for any damage or loss to the artwork during or after delivery.
9.2. The Artist is not responsible for any delays or issues at an Event from factors beyond their control, such as weather conditions, venue restrictions, or illness.

10. Copyright and Usage Rights
​
10.1. The Artist retains copyright of all artworks, allowing their use in portfolios, promotional materials, and social media, even after final payment and delivery to the Client.
10.2. The Artist may create and sell prints of commissioned pieces that do not include identifiable personal elements. Clients may not sell reproductions without the Artist’s consent.

11. Privacy and Data Security
11.1. The Artist ensures all client information is kept confidential and used only for service provision.
12. Legalities
12.1. These Terms and Conditions are aligned with the Client Agreement, which will be provided for review upon booking enquiry. The Client Agreement outlines the booking and commission processes. Accordingly, these Terms and Conditions are governed by the laws of England and Wales.
